Terms of Service

The terms that govern access to Avelis AI, its AI features, connected services, subscriptions, and credits.

1. Acceptance of Terms

By accessing or using Avelis AI ("the Service") operated by Allcognix AI Technologies Pvt Limited, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Acceptable Use Policy (AUP)

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to:

Prohibited Activities

  • Illegal or harmful content: Generate, create, or distribute any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Hate speech and harassment: Create content that promotes hate speech, discrimination, harassment, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
  • High-stakes regulated content: Generate content that provides medical, financial, or legal advice without proper qualifications and disclaimers. The Service is not intended for use in high-stakes applications where errors could result in serious harm.
  • Fraudulent activities: Use the Service for any fraudulent, deceptive, or illegal activities, including but not limited to phishing, identity theft, or financial fraud.
  • Intellectual property violations: Generate content that infringes upon the intellectual property rights of others, including copyrights, trademarks, or patents.
  • Malicious code: Generate or distribute malware, viruses, or any other malicious code.
  • Spam and unsolicited communications: Use the Service to generate spam, unsolicited commercial communications, or bulk messaging.
  • Unauthorized automation: Use connectors, MCP integrations, skills, or scheduled Actions to access third-party systems or data in violation of those systems' terms or without proper authorization.

Violation of this Acceptable Use Policy may result in immediate termination of your account and legal action where appropriate.

3. AI Output Disclaimer

Important: The AI-generated content produced by Avelis AI may contain errors, inaccuracies, or "hallucinations" (instances where the AI generates false or misleading information). The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of accuracy, completeness, or fitness for a particular purpose.

You acknowledge and agree that:

  • AI-generated content should be reviewed, verified, and validated by qualified professionals before use
  • You are solely responsible for the accuracy, legality, and appropriateness of any content generated using the Service
  • We do not warrant that the Service will be error-free, uninterrupted, or secure
  • We are not liable for any damages or losses resulting from your use of or reliance on AI-generated content
  • You should not use AI-generated content for critical decision-making without human oversight and verification

4. Intellectual Property Ownership

User Input Ownership

You retain all ownership rights to the prompts, data, files, and other input you provide to the Service ("User Input").

Generated Output Ownership

You retain ownership of the content generated by the Service based on your User Input ("Generated Output"), subject to your compliance with these Terms and applicable laws.

Service Ownership

The Service itself, including all software, algorithms, models, documentation, and other materials provided by Allcognix AI Technologies Pvt Limited, remain the exclusive property of Allcognix AI Technologies Pvt Limited and are protected by copyright, trademark, and other intellectual property laws.

By using the Service, you grant us a limited, non-exclusive, royalty-free license to use your User Input solely for the purpose of providing and improving the Service, in accordance with our Privacy Policy.

5. Account Registration and Security

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

6. Payment and Billing

If you purchase a subscription or credits:

  • You agree to pay all fees associated with your account
  • Fees are charged in advance on a monthly or annual basis, or as a one-time credit pack purchase, depending on the plan you select
  • All fees are non-refundable except as specified in our Refund & Cancellation Policy
  • We reserve the right to change our pricing with 30 days' notice
  • You are responsible for any taxes applicable to your use of the Service

Payments may be processed through third-party providers such as Stripe or Razorpay, depending on your region and checkout method.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time through your Account Settings or by contacting us at [email protected].

8. Limitation of Liability

To the maximum extent permitted by law, Allcognix AI Technologies Pvt Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
